Gap between BRPs

Post by Ranad Maswadi » Sun Nov 14, 2021 1:06 pm

Hi All

I'm a doctor at the NHS. I've been working here for the past year and a half. I hope I can apply for ILR at some stage. I appreciate if someone can advise regarding the regulations for continuous visa.
My first job was from 15.6.2020 until 15.6.2021. I received the offer for my next job on 1.4.2021. The job to start on 1.7.2021 However, the HR only sent the CoS on 28.6.2021, which is almost 2 weeks after my termination date. Does this mean that year doesn't count for ILR now? Is there anything to do about this? There work only excuse was that they were short staffed because of Covid, despite that everything from my side was ready!

Moreover, I'm now moving jobs again. I have a job offer from another hospital. the job started also a couple of weeks (~ 4 weeks) after my termination date. If I receive the CoS and apply for visa renewal before my last date at my current job, does this make it a continuous visa, even if the start date is a few weeks after the termination date?

Apologies, It's really confusing for me, being relatively new to the system.

Man Thanks

There is NO rule that you must have continuous employment without any gaps.

For continuous residence, it is your visa validity and ensuring you apply for your next visa before the previous one expires.

Thank you for replying. But what does end a current visa? is the BRP terminated automatically the day I leave my current job?
I don't think I quite understand what my status is, if i decide to end my current job sooner than the contract end, and while BRP end date is still not reached.

No it is not.

You are overthinking

There is no issue here provided you apply for a visa while still holding a visa that is valid.

When is the expiry date on your first BRP and did you apply your second visa before that ?
