You have made an in time application therefore she will not be considered an overstayer. She will continue to have same rights as before till this decision is out.Fid7 wrote: ↑Fri Dec 17, 2021 6:17 pmHi, my wife’s spouse visa (5 year route) is due to expire today and we submitted an ILR application yesterday. We were given till February 17 to submit additional documents. We will be able to submit all documents within the next few days but will she be considered as an overstayer? Sorry for asking, maybe I am a bit naive, thanks.
As long as the application is pending and no decision is made, she is ok. The deadline is given so that if you do NOT submit the requested documents by that time, then UKVI will proceed without them (which mostly leads to a refusal)Fid7 wrote: ↑Fri Dec 17, 2021 6:17 pmHi, my wife’s spouse visa (5 year route) is due to expire today and we submitted an ILR application yesterday.
