ILR - Set (LR) - Document showing child immigration status

Post by bmans85 » Fri Jan 21, 2022 5:26 pm

Hello Experts,

I'm looking for some urgent help!

I'm eligible to apply for ILR in long residence route (10 years). We have 2 children, with my younger one born in March 2020 and i havent applied Indian passport for her ( because of lockdowns, long delays in getting appointments etc) so obviously doesnt have a valid visa.

Having filled the application form, before i submitted, i observed that one of the documents mentioned at the bottom of the PDF is:

Document(s) showing your child / children's immigration status

Does this mean that i need to apply for Indian passport & dependent visa for her before i can submit the ILR application?

I always thought my child doesnt need a passport/visa to stay and after i get ILR, i can apply for Naturalization and then British Passport.

Please let me know your thoughts on this

Thank you :)

ILR eligibility

Post by bmans85 » Fri Jan 21, 2022 5:44 pm

Hi All,

Entry to UK on T2 short term visa - 17 Jan 2012
Exit UK - 16 July 2012 (visa valid till 31st July 2012)
Entry back to UK - 10 Sep 2012 (New visa valid from 31st Aug 2012)

In 2017, i switched to PBS dependent and in 2018, again to Tier 2 Long term, but in both cases, travelled to India when visa was valid for few more months and came back on new visa.

My query is mainly for the first entry, as i applied for a new visa after expiry of old visa, if that period would be counted as 'Continuous Stay'.

Please can you confirm if im eligible for ILR now and also is it a simple case or do i need to go through a solicitor?

Many Thanks

You cannot apply for ILR on SET(LR) for a child that does not have 10 years legal residence. SET(LR) also does NOT permit you to add dependents to your application. Only one applicant can apply on SET(LR).

A UK born child also does NOT require ILR if you intend on registering the child as British.

There is no break in your continuity of residence.

Hi CR001,

Thank you for your response.

Apologies if i have confused with my question.

I'm not applying ILR for my child. Its me applying ILR in Long route, but one of the documents needed for this application is 'Document showing Child/Children Immigration status' but i havent taken Indian passport for her, so what should i produce to prove her immigration status?

Thanks
Bala

These documents are NOT needed. Set LR has minimal documents and your dependents documents are irrelevant!

Thank you CR001, but as this document is in the list of documents required, do you suggest me to mention on the application form that my second child doesnt have a passport and Visa and just attach the birth certificate OR do you suggest me to just ignore that document and attach everything else ?

Apologies for multiple questions, just wanted to ensure i'm not doing anything wrong especially with the cost of ILR application being so high :)

Many thanks to all the moderators on this website who have been helping out 1000's of people :)

The checklist is generic. You should only follow the rules and guidance notes which are very clear what is needed.

ILR Set (LR) - UK Entry/Exit dates

Post by bmans85 » Mon Jan 24, 2022 2:51 pm

Hi All,

I'm filling the application form for ILR in SET LR category and there is a confusion for me in Entry/Exit dates section.

From 27th April - 5th May 2013, i have been on a Euro tour, with France being my port of entry and exit, but i also visited Belgium, Germany, Swiss & Italy.

In the application form, should i have just one entry with exit as 27/04 and entry as 5/5/2013 and Place as France but also mention about other countries in the details box below or i should have multiple entries for each country with the same entry and exit dates?

Thank you

The details of your travel are not relevant. UKVI does not care about it. Just say you visited France
