UK Arrival Stamp Missing

Post by Baksa » Sat Jan 29, 2022 11:50 am

Hi,

I am preparing for my wife's ILR application and have been checking UK arrival stamps on her passport. It does seem that the last time we returned from a trip abroad (on 13 January 2022), the immigration officer must have forgotten to stamp her passport on arrival. Will this cause an issue with her ILR application, and what can I do to resolve this?

Hopefully, they should have a record of her arrivals. Did she keep her boarding cards or tickets?

She was finger printed, and her passport scanned on arrival. We found the paper boarding pass (the small part that is given to us after they keep the main one). We also should have online check-in confirmation sent by email. Is there anything we can do further?

I mean do we need to add a note about this in the cover letter? and will this delay the processing of her application (we are planning to apply using the priority service).

Probably just add a note in a cover letter.

Correct immigration rules for ILR dependents

Post by Baksa » Sat Feb 26, 2022 1:40 pm

I entered the UK in 2013 as Tier-2 General migrant then settled and naturalised under same route. My wife and son entered in 2017 and they are now applying for ILR. I know that Tier-2 has been replaced by the Skilled Worker route.

What is the relevant set of immigration rules that they have to satisfy?
Are they SW37-SW45? or the old 319E and 319J?

I can see that these two sets are very similar but I am preparing a cover letter and want to quote these rules one by one and show that my dependents meet them.

Start of five year period for Tier 2 dependents

Post by Baksa » Fri Mar 04, 2022 10:02 am

Hi

What is the start date for calculating the 5-years qualifying period for the wife and children of a Tier-2 migrant (already settled). Is it the date they were given leave to enter clearance, or the date they actually entered the UK. I searched the immigration rules and could not find anything about this, can you please point me to the relevant section of the rules. Also, where in the rules it says they can submit ILR application 4 weeks before the end of the 5 years.
