ILR Eligibility Date

Hi All,

Just wanted to get confirmation on my calculations:

Initial Visa issued:            14/09/2017
Initial Visa expired:           28/06/2020

Arrived in UK:                  01/10/2017

Visa Extension issued:          10/03/2021
Visa Extension expires:         27/05/2023

Max 20 days spent out the country in the entire 5 year period.

According to my calculations the earliest I could apply is on the 16/08/2022? Is that correct?

You have not stated what route or Immigration pathway you are on.

Ahh sorry. Spousal 5 year route. SET(M) is what I will be applying for. My wife is a British Citizen by birth.

Under SET(M) the qualifying period start from the first date of entry to the UK :!:

Thanks, but it also says:

"The period between entry clearance being issued and the applicant entering the UK may be counted toward the qualifying period. Any absences between the date of issue and entry to the UK count towards the 180 days allowable absence in the continuous 12-month period. The applicant does not need to provide evidence to demonstrate the reason for delayed entry. If the delay is more than 180 days, you can only include time after the applicant entered the UK in the continuous period calculation."

My Visa was issued on 14/09/2017 and I arrived on 01/10/2017 (17 days). Since this is still within the 180-day allowance, wouldn't it be counted as an allowable absence?

So in reading that it my interpretation is the home office include the time between the granting of the initial visa and my entry into the UK as part of my leave time in the UK.

You are wrong. The guidance you posted is only relevant to the specified visa categories in the document, ie tier 2, tier 1, Ancestral visa etc.

Thank you both, I'll calculate from the day of entry! Looks like 3rd September 2022. I'll probably just apply on the 5th to be safe :D

Hi,

I'm applying for SET(M) via 5 year spousal route. My wife is a British Citizen by birth and we have 2 children both born in the UK.

When filling out the finance section, it says "The Financial Requirement threshold which has been calculated £18600". As a salaried worker I earn 2x that a year. I've filled in all my details and supplied P60's/Bank Statements/Letter from Employer/Payslips etc....but do I still need to do the same for my wife if my salary exceeds the Financial Requirement threshold?

No. If one of you satisfy the requirement then you do not need to add any additional income
