Given grace period to reapply after a wrong Set M application

Post by Cee3 » Tue Apr 12, 2022 3:55 pm

Hello All,

Thank you for all you do. I would like some advice with my application please.

Husband came to UK 2009 with student visa. Finished 2010 and got a post study visa till 2012. Then moved to Tier 2 (G) until end of 2017. Got ILR from 2018 to 2019 and got his naturalisation in 2019.
I came with student visa 2012 which ended in 2015. I became husband’s dependant from end of 2015 to 2018. Then applied for second round of PBS until end of 2021. I applied for ILR (Set M) in December 2021 and got a notification 4 months later (last week) that it is the wrong one. I’ve been given 14 days to review and do a fresh application, while they hold on to my old application. My money would be refunded after the 14 days. I have read the guidelines again and think it should have been Set O.
My questions are as follows.

1. Is Set O what I should have applied for? (It is what I’m currently completing)
2. Is this the correct category I’m applying for? (Skilled Worker, Tier 2 or International Sportsperson dependant)
3. Which visa is he applying for or been granted? Is Tier 2 General Visa correct? (Even though he’s got his citizenship)
4. What will I say is his country of nationality because it asked for that, as well as the passport number? Birth country or British?
5. How do I answer the question, have you got a valid visa? (I want to say yes, because I made an application before my visa expired and they are holding on to the previous application. Is that the correct answer? Or should I state no and give them the same reason)
6. It is asking for my sponsor’s Licence number. I added the last one he had, but it doesn’t recognise it. Is this because he has naturalised? Am I still on the right track?
7. It hasn’t asked for my finances, but there is a consent form with 3 parts. My partner isn’t sponsoring me financially, but we have joint utility bills. Does it mean I sign the 1st part while he signs the 2nd part, then we ignore the 3rd part?
8. Will the £18,700 financial requirement come up in this application? I haven’t come across it anywhere.
9. Will I pay the fees for this new application and go for another biometrics?
10. How will I go about asking for a refund if made to pay new fees?

Thank you in anticipation of your response.

(It is what I’m currently completing)Yes. Alternatively you can apply for Set LR if you have been in the UK for 10 years
2. Is this the correct category I’m applying for? (Skilled Worker, Tier 2 or International Sportsperson dependant)Yes
3. Which visa is he applying for or been granted? Is Tier 2 General Visa correct? (Even though he’s got his citizenship)Yes
4. What will I say is his country of nationality because it asked for that, as well as the passport number? Birth country or British? If he has dual and the form allows, enter both
5. How do I answer the question, have you got a valid visa? (I want to say yes, because I made an application before my visa expired and they are holding on to the previous application. Is that the correct answer? Or should I state no and give them the same reason)Yes
6. It is asking for my sponsor’s Licence number. I added the last one he had, but it doesn’t recognise it. Is this because he has naturalised? Am I still on the right track? Most likely the company is no longer on the sponsor list, but this won't affect your application. Try if there is an option to not answer this question and move on
7. It hasn’t asked for my finances, but there is a consent form with 3 parts. My partner isn’t sponsoring me financially, but we have joint utility bills. Does it mean I sign the 1st part while he signs the 2nd part, then we ignore the 3rd part?Yes
8. Will the £18,700 financial requirement come up in this application? I haven’t come across it anywhere. There is no financial requirement for SetO
9. Will I pay the fees for this new application and go for another biometrics?Yes. Also better to add the UAN of your SetM application at the beginning of the SetO form where you were asked "if you have existing application with UKVI"
10. How will I go about asking for a refund if made to pay new fees?It should be automatic. If not received, https://www.gov.uk/contact-ukvi-inside-outside-uk

Thank you in anticipation of your response.

Thank you so much for the quick response.

I've completed and submitted the application. I was lucky to get a priority service.
