Dear all,

I would like to ask a question regarding my wife immigration status

I was on Tier 2 visa for 5 years route and when I submitted my ILR application in September on standard service , my wife was not done her English and life in the uk test , I got a wrong advise that she needs to submit FLR (M) application to extend her visa .

I got my ILR application approved in March and her application is still under consideration, however I have been told by a Lawer that her 5 years as dependent will be reset to zero and needs to start again before she can apply for ILR , so my question is that

Is there anything I can do now to correct this mistake ?
For example , can I contact HO and ask for resubmit the correct application (extend her tier2 depend visa as I did for my children)

Note: she and the kids have joined me from the day of arrival in 2016

Has she done the English and LIUK tests? If yes, she can submit ILR application now quoting the FLR(M) UAN at the beginning of application form. This will effectively "vary" the FLR(M) application to ILR application. If no, she can do the same with a skilled worker dependant visa.

You need to do this before the FLR(M) decision is made.

Thanks for your quick response, no she has not done her English language and life in the uk test yet.

Should I contact the HO first to ask about this or I just want to submit a new application asap?

UKVI knows it when you vary the application. No need to contact beforehand.
