Routes under ILR

Post by arii2019 » Tue Apr 26, 2022 12:38 am

I am looking to make an application for an ILR application. I made this application in 2020 and was granted a 2.5-year leave to remain visa instead, based on my parental responsibility instead as I picked the wrong category (I.e. leave to remain as the partner of a settled person). So want to make sure I pick the right category this time. My immigration history:

Sep 2009 - oct 2013 tier 4 visa

In Oct 2013, I applied for leave to remain as a spouse but was granted leave to remain on the basis of family & private life from July 2014 to January 2017.

January 2017, I have applied for leave to remain as a spouse and was granted leave from Feb 2017 to Sep 2019.

In Sep 2019, I applied for ILR as the partner of a settled person but was instead granted a 2.5-year leave to remain visa instead, based on my parental responsibility from Jan 2020 to July 2022.

So can I apply for an ILR now, on the basis of being in the UK for 10 years? I believe I won’t qualify under the other routes. Will the gaps between the time my visas were issued in the past be an issue when working out the 10 years? All applications were made while I was on the UK.

You should qualify already under ILR LR (Long Residence).

Thanks! This is what I think too, but I am slightly worried as I have picked the wrong categories last time.

My passport has recently expired would this cause a problem?

You need a valid passport to apply. Renew before applying

I am in the process of completing an application based on my long residence. I have been asked evidence of parental access, since our daughter lives with my spouse and I, can this be a letter from my partner. I am hoping that I won’t be asked to follow the spouse/parent route because I have said I am living with both..

The long residence has nothing to do with your partner or child. Ignore the list as it is inaccurate in this instance
