Unexpected Long Delay in ILR Set (O) Application

Post by NeedAdvice4ILR » Mon Jun 20, 2022 6:04 pm

Dear all,

I have a question about our ILR Set (O) application and would appreciate it if you could answer.

We applied for ILR Set (O) under Super Priority Service, Biometric enrolled/showed on 03/06/2022 and have been waiting the result. You can see the progress below.

Applied for ILR Route: SET(O)
Application Type: Super Priority Service
Date application submitted: 20/05/2022
Biometrics enrolled: 03/06/2022
Documents received by HO: 03/06/2022

Additional Document Requested: On 06/06/2022, I received email from Home Office Case Worker asking clarification why we haven't included our UK born child in our ILR application. I responded on the same day by attaching out child's birth certificate that our child was born in the UK, and he will be eligible to apply for British Citizenship after one of the parents receives ILR, as explained on the Home Office's web site: https://www.gov.uk/apply-citizenship-born-uk/under-18

On 14/06/2022: received another email from Home Office Work Sponsored Routes Team that they checked that the caseworker contacted me to request some further evidence on June 6 and once this evidence has been provided, they will be in a position to consider our application.

Result: Still waiting

2 questions:
1) Our child (3 years old) was born in the UK, so we don't need to add him in our ILR application as he can register as a British Citizenship once one of the parents has ILR, as explaind on Home office website: https://www.gov.uk/apply-citizenship-born-uk/under-18

Currently, our child has a Tier 2 Dependent Visa to travel and it will expire on July 3, 2022. We will apply for his British Citizenship once our ILR is approved (hopefully). Do we have to extend his visa while waiting the ILR application result to make sure that his visa will not expire?

2) Our ILR application is under Super Priority Service, but it has been taking much longer than expected (since June 3). Any suggestion to speed up the process so that we can get the result soon? Any potential explanation why this takes for a long time under Super Priority Service?

Many thanks

Do we have to extend his visa while waiting the ILR application result to make sure that his visa will not expire? Not required. As you've rightly pointed out, a UK born child doesn't need any previous visa before registering to be a Brit. Using the NHS is entirely different though. You might need some health insurance to cover that.

2) Our ILR application is under Super Priority Service, but it has been taking much longer than expected (since June 3). Any suggestion to speed up the process so that we can get the result soon? Any potential explanation why this takes for a long time under Super Priority Service? Nothing, they're still looking at it. It is what it is.

Many thanks
No sin in failing, you just have to try and try again!
