ILR eligibility query

Hello, I hope someone can help me here please.

I have applied for Tier 2 skilled worker dependent visa application mid-June 2022 and have not heard anything back from home office yet.

I am due for ILR mid-November 2022, so I was thinking if a person can go ahead (or not) with an ILR application IF home office doesn’t do anything till mid-November.

Can you please advice-
a) Am I allowed to submit my ILR application in Nov as I am eligible as per the 5-year rule?
b) What would happen to the existing dependent visa application which is in progress with home office i.e., will it be superseded by ILR application?
c) Any idea if home office provides refund for the existing dependent visa application in such cases?

And a slightly different question on ILR- Do we need to provide Ecctis letter to demonstrate English qualification for dependent ILR applications also?

2. Correct. The new application will be a variation of the previous one
3. They should

English language evidence is required for ILR. It can be one of the many accepted pieces of evidence including ECCTIS (same as NARIC)
