ILR Set(LR) Application Help!: Problem with Skilled Worker Supplementary Employment

Post by fisheye » Tue Oct 04, 2022 10:22 pm

Dear helpers,

I have a very specific case here.

I submitted my online application for ILR Set (LR) aka 10 years long resident permit via super premium service on the 3rd of Oct. I will have my appointment this Thursday.

Situation
I am currently on a Skilled Worker visa, and I took supplementary employment from another employer from June to Sep this year. So on the application form, I only put my main sponsor as my current employer.

My question:
1) Do I need to submit an employment statement letter from my part-time job employer to explain I only worked for them from June to Sep?
2) Does this complicate the case as the employer needs to explain less than 20 hours, same occupational code etc.?

Rationale
The reason I am asking this question is I know the case worker has access to the HMRC data. They can see the PAYEE from my part-time employee from June to Sep. But I don't think my part-time employer lodged any file to HMRC telling them I stopped work yet and tbh I actually don't know how filing to HMRC works. And they may also ask why I had/have another job in the PAYEE.

I don't want the case worker to think I am still working on this part-time job and assume I am intentionally not disclosing my supplementary employment aka part-time job. So he/she refuses my ILR Set(LR).

Hope someone can enlighten me on this situation.

I am really stressed out.
And now thinking of many other imperfect flaws maybe in my application.

(1) Why is there no place to fill in all my employment history? Does the case worker check it?

(2) The last question asks 'do you have any other reason to stay in the UK' the example is related to family, children etc. I think it is more associated with human rights. Can my new job offer (contract) potentially drops into this 'other reason' want to stay in the UK? It is too late to change my application but I just want to understand the legal ground for those questions.

Employment is not a requirement for ILR, so don't stress about that! It's easy to overthink everything but no reason to worry about things that aren't asked.

ILR LR application has the most minimal of conditions. The above questions supposed to be asked before now and appears you are only worried post application.
The 2nd question needs to be truthfully answered as it applies to you

Thank you for the answer. It is a very expensive and stressful process.

Re- 2nd question. I was genuinely thinking that question is more related to human rights, family members, etc. from the example given on the form. So I didn't put my career or new job offer there.

Hi guys,

Go back to the question I asked in the OP.

I didn't put my supplementary employment because my last work for the part-time employer is 30th Sep. 2022 (started in June). I submitted the application on 3rd Oct. 2022 without putting in the supplementary employment (because I resigned).

I am worrying the HMRC record won't update/refresh quickly enough to show I am not working on the supplementary employment anymore. And the Case Worker may refuse my application on this basis (ie. they may think I am still working on the supplementary job but didn't disclose it on the application). Should I ask my employer to write me a letter to submit to UKVI?

Am I worrying too much? :o :o

The reply to the question has no effect on your ILR (LR) application.

It's not a trick question. Just answer as you deem fit.
No sin in failing, you just have to try and try again!
