Can dependents apply for ILR

Post by naija99 » Mon Feb 20, 2023 10:01 am

Good morning forum
Please could gurus advise - my friend applied for a spouse visa and was granted initial 33 month and then 2.5 years which expires in May 2023. She is now going to apply for ILR.
She has applied for her two children who arrived in Dec 2022. They were granted entry only until May 2023.

Can they apply for ILR at the same time as she does?

Children can apply for ILR when she does. There is no 5 year residence for children.

CR001 please could you confirm if its possible to pay for premium service for the main applicant but normal service for the two children?

Yes, possible. You would have to apply separately for the children though. Expect delays in the partner application as ukvi will want to know what you are doing regarding the children.

Note it is not called premium service.

You only have the options of standard service or super priority (costs an extra £800 per applicant) and is not a guaranteed service, if it is available when you apply.

How old are the children?

Please could you confirm the name of the separate form for the children in that case because she would like to apply separately.

Same form name as the spouse.

Note it is far easier to include the children on the spouse's application.

Standard process is currently taking between 4 and 8 weeks after biometrics.

Why do you need super priority for the spouse application? It is not a guaranteed service.
