Am I eligible for ILR based on FLR(M) - away from UK for long time along with family

Post by abcz1020 » Sat Mar 04, 2023 12:56 am

I am on 2nd extension of FLR(M) visa, but since I got the 2nd time FLR(M) I am in USA with my husband (British Citizen) and 2 kids both (British citizen) for almost 15 months, we had a family reason for such a long stay. We are thinking to go back after 3 months and going to apply for ILR. Would it be possible to explain the reason of such a long stay and my husband mother passed away and have to look after his dad who needs support. My question is can we apply for ILR on one day premium service. We also have a property in london and I have read that there is no absence limit for the spouse visa. Please suggest an outcome for this.

Thanks

The family route has no absence limit and it only has a continuous residence requirement. This means you need to hold 60 months of visa continuously. You are also required to provide cohabitation evidence for the last two years. I believe your ILR should be successful
