Spouse visa to ILR

Post by scro1503 » Sat Apr 15, 2023 5:13 pm

I am writing to inquire about my eligibility for Indefinite Leave to Remain (ILR). I submitted an application for limited leave to remain as a five-year partner route on 8th June 2018, which was granted on 10th July 2018. However, my Biometric Residence Permit (BRP) card expired on 7th December 2020. It appears that the granted 30-month limited leave to remain was calculated from the application submission date instead of the granted date.

I would like to know from which date I am eligible to apply for ILR. Should I apply on 8th June 2023 or 10th July 2023? I would appreciate any clarification you can provide on this matter.

Thank you for your time and attention.

When did you enter into UK on the initial spouse visa granted in June 2018 or were you already in the UK and switched to spouse visa route?

Your qualifying period for ILR starts from the date your visa was granted, not from the date of initial submission.

Thanks for your response, but why my first 30 months were granted based on submission date i.e. 8th June 2018 to 7th Dec 2022? Quite confusing

If you know the date it was granted then that is what you use in calculating your eligibility for ILR.
