what to select for Section D Q-5 Tier1 applying within UK

Hi guys I am applying for HSMP tier 1 and i am confused what to select for question 5 in section D
Here is my status:
1. i came to london in Jan 2006
2. got my new passport in Oct 2006 as my previous passport was expired
3. then i went back to india in May 2007
4. and then again i came in July 2007 to take up a new job in London and got my workpermit transferred.
5. so i have my old passport that has my initial workpermit and now that work permit is expired
6. new work permit is on new passport

question is:
in Section D 5
D5. Are either the applicant’s current and/or any one of his/her previous passport(s) or travel document(s) that he/she has used to travel to, and remain in, the United Kingdom which shows his/her current leave unavailable?

for above question what should I select YES or NO
any help would be grateful

You have to select No.
and make sure to send your both passports along with your application to the home office.
