HSMP Forum Ltd. Judicial Review - fresh application

Hi
I have a doubt in respect to Section G, i am applying HSMP tier 1 for first time should i select YES or NO for section G question 1, 2


Section G states:
G. HSMP Forum Ltd. Judicial Review


G1. Does the applicant consider him/herself to be covered by the HSMP Forum Ltd. Judicial Review Judgment of 8 April 2008?


G2. Does the applicant wish to have the application assessed in accordance with paragraph 39-42 of the HSMP Forum Ltd. Judicial Review: Policy Document?

what should i need to select YES or NO for above 2 questions

Note: i am applying HSMP with in UK
