5 months and still waiting

Post by graybound » Wed Nov 26, 2008 3:04 am

My parents appealed for legal status in the UK earlier this year (they are/were illegal immigrants for over 25 years) and my father was granted this request around 5 weeks ago, but since then we've heard of nothing on my mother. Things get more complicated as we applied for our case to be treated as a family (including myself - I was born in the UK and have lived here my whole life without leaving the country or ever being involved in any crime).

My parents actually applied for this back in 2005 (before I was aware of this situation) but was denied by the HO. This is why we went to court on appeal earlier this year (so really we've been in this mess for 3+ years).

It's been 5 months since and I've also heard nothing from the Home Office (meaning that I've been forced to take a gap year from my education and basically do nothing during this period as a result).

We've been in financial trouble for a very long time now, which is why we applied together as a family (and not on an individual basis as I could have done under this). The fact that this has taken so long to resolve doesn't suprise me based on the situation, but what does is how they decided to give my father legal status and not give a response for my mother and myself. Surely if I had simply applied by myself this would have been over by now? (they say the averge is up to 6 moths). As mentioned earlier I did know that applying as a family would most likely take longer to resolve but with my father being okay why am I still waiting?

We've tried contacting our local MP (who then forwarded our letter to Phil Woolas) but havent heard from him since (5 weeks) and our solicitors are contacting the HO on a daily basis but I just feel so hopeless.

I don't really expect anyone here to know when this will be sorted out but I just feel that getting things off my chest will help me feel abit better. Any advice/responses would be appreciated.

It's been 8 weeks now since writing in to our MP and 7 months that we've been waiting for a response from the HO (on myself and my mother). Does it really take this long for either to send a response? :(

It can take 2 years or more for the 14-year long residence category. Has your father received the ILR vignette in his passport yet? Do you know if you are being treated as a family unit?

I hope that by tacking on yourself on your parents' application, you haven't made matters more complicated that it sets everything back.

thanks for replying.

Yes he has, over 2 months ago.
Do you know if you are being treated as a family unit?
That's the problem, it was made very clear to them that we were to be treated as a family unit (so if my father were to be granted ILR, then everyone else would and IF not that I surely are more likely to be granted this above either parent). As far as giving a definitive answer, atm I couldn't.

Something that I left out of my first post is that my parents actually applied for this back in 2005 (before I was aware of this situation) but was denied by the HO. This is why we went to court on appeal earlier this year.
