SET M ILR application - HELP

hello all,

I am British and will make ILR application for my wife, she was on a family visa. We got confused one some questions on the form, would you please help us ?

1- Her first visa (the vignette on the passport) started at 01/09/2020 and we entered the UK on 22/09/2020. When can we apply earliest ?
Can we apply it from 28 days before 01/09/2025 or 22/09/2025 ? When does 5 years starts ?

2- for the absences the following question confused us , we have lots of absences like 6-8 days. so does it mean we only need to put absences more than 2 weeks ?( either way she is still in the limits)

1. The 5 years starts from the date you entered the UK under the family route

2. There are no absence limits under the family route.
Just enter absences of longer than 2 weeks but they should not affect you. They just need to ensure that you mostly lived together

I searched this online but could not any guideline or info on the both points. do you know where can I find any guidelines around those topics on gov.uk ?

The advice is based on the immigration rules under Appendix FM. The advice is common knowledge if you are familiar with the immigration rules and have the required experience to interpret them.

1. The rules require the qualifying period to start from the point you and your spouse started living in the UK. That means the time between visa issue and entry does not count

2. Unlike other routes, the rules do not impose any limits or restrictions under the family route, hence there is no limit. The rules do not tell you there is no limit, it simply does not impose a limitation which means the same thing

just to clarify and summarise , can we apply her ILR application 28 days before 22/09/2025 or 28 days not applicable to family route either ?
