1. Useful to state the visa expiry date is.

2. Yes. Register UK born child once you have ilr. Ask these questions in the British citizenship sub forum please.

3. She applies for ilr when your spouse does. She cannt get ilr if your spouse is not also applying.

Thanks for the response.

I got another question. My wife will be eligible for ILR in roughly around after DEC2025, but her visa expires in October2025, Can i know if i can bridge this gap in what circumstances.
1) apply for extension visa and wait for the time of approval, if its not before december can i take a chance to apply for ILR and will my extension visa IHS amount will be returned.
2) Or any other source to bridge this gap

It would be great if i get a right advice on this. Thanks

It is possible to apply early and delay the biometrics

Read: All you need to know about applying early, the application date, 28-day concession and more

thanks for the response i have gone through the link & i got some crucial information.

In that sense how long i can extend the biometric date?
is there a good chance will i get my IHS refund if my ILR application is considered
Her vignette says 7 Jan 2021 so theoretically before 28days is 10DEC 2025.
For example i submit the application on October 5th 2025 and took a biometric appointment for 15Nov 2025 (40days). what would be the situation in a case where the Extension VISA approves before 10th Dec 2025. Hope i dont have a chance for the refund.
In case i have not got any response i can go ahead and apply the ILR on 10th DEC 2025 and book an appointment and earliest biometric. Now both the applications are considered and which wins the race and will be loosing the money for both & will i get refund for my earlier extension IHS fees.

am bit confused and helpless here sorry if my question is convulated

You apply directly for ILR in October, ideally on the last day of visa expiry. I suggest the standard service
The biometrics can be delayed for up to 45 working days. You do not need to apply for extension at all and avoid all the hassle

Thanks for the response, Which means you are telling me not to apply for Extension Visa. Apply ILR directly?
October 8th 2025 is the last visa date , which means + 45days is Nov25th 2025. But by that time she wont be coming under qualifying dates right.
So you mean to say when i submit the biometrics as a standard and the moment it goes to case worker the time will be matching right, but how it is calculated is that biometric date, application date or file is with case worker?
What if they reject am bit worried, can you give me bit more clarity on this.
Thanks

Yes that is what I am saying.

8 October 2025 + 45 WORKING days = 10 Dec 2025

I got some responses could you please confirm how correct is this?

Your ILR application is protected under Section 3C once submitted.
Biometrics can happen later, even weeks after expiry.
The Home Office will consider your application date (submission date), not the biometrics date.
In UK immigration law, the date of application is the date you submit and pay online, not the date you attend biometrics or when a caseworker looks at it.

That is largely incorrect and contradicts the immigration rules under paragraph CR 6.1. The immigration rules tell you that the date that is most beneficial to the applicant is used. What I described allows you to benefit from the date of ILR decision

AGAIN READ: All you need to know about applying early, the application date, 28-day concession and more

The advice given to you is common knowledge and has been given to many applicants before.

so in theory date of biometrics is considered as a qualifying date in that sense if i try to secure a biometric date of 10th dec 2025 with standard route than there is a possiblity, on 10th DEC 2025 cant i go for 5day priority as i will be eligible by that day right?

The date of biometrics is actually irrelevant.
The date of ILR decision is used. Please READ the advice given. I cannot repeat this over and over and over again. You can choose any visa service as long as on the date of your biometrics you are already eligible for ILR as the date of your ILR decision will be on or after that date, hence allowing you to get ILR.
