Child Benefits claim clarification

Hello,
I moved to the UK in November 2016 on a Tier 2 (General) visa and was granted ILR in 2021. In the meantime, my family joined me in October 2020 as dependants (partner and child).

After I received ILR (with no restriction to public funds), I was hesitant to apply for Child Benefit in my name for my dependant child, as there did not seem to be a clear, definitive answer on eligibility.

Later, I came across the following link regarding Child Benefit claims:

Based on this, I applied for Child Benefit for my child under my name in November 2022. Recently, my dependants were granted ILR (wife and child) without any issues.

I thought to share this information for others’ reference. Please note, I am not an immigration advisor or solicitor—I am simply sharing my personal experience.

If a the child is subject to immigration control (ie - no recourse to public funds restriction) you claiming benefits due to their presence may breach their immigration restrictions. However, I’ve never seen a case in practice where this has been an issue for a child. It’s a choice you have to make as to whether you want to take a potential albeit unlikely risk.
