Preston settled to settled.

Hello everyone

Need some info/directions with regards to my family's conversion from pre settled status to settled.
I am a qualifying British citizen living with my family who are all on pre settled visa. My family started living in UK in November 2020 and got their pre settled status in March 2021. My kids who are 24, 22 and 20 years old. The questions that I need help with are:

The 24 and 22 years old are working and no longer dependent on me. The 22 years old still dependent on me. What options they have once their 5 years has completed this November. Can they apply for settled status?
Secondly, the 24 years old has got married. Will that be an issue? (His spouse is not here in the UK).

How did you family get their pre-settled status? Via Lounes or Surinder Singh routes? Or you are an EU citizen and they got their pre-settled statuses before you naturalised?

Hello

Thank for your reply Ixeon659. I'm a British citizen and was living in The Republic of Ireland. My family joined me there. We all came to the UK in November 2020. I applied for their pre settled visa using the paper forms. So November this year their 5 years residency will complete. All of my children were under 21 and were dependent on me. 2 of them are now over 21 and working.

So it seems it is a Surinder Singh case, they should be able to apply for settled status using the paper form. Call the EU Settlement resolution centre and request a paper form for all you family members.

Regarding your grown-up children, here is a quote from Appendix EU:

“Where a person has already been granted pre-settled status as a dependent parent or dependent child, they do not need to demonstrate that they remain dependent in order to qualify for settled status under Appendix EU.”
So they all should be fine

Really appreciated your quick response Ixeon659.
I know I should have asked this in my previous post, my eldest son also got married. Will that be an issue? Because I think he has to mention whether he is married or not in the paper application form when he apply for settled status.
