ILR eligibility for dependant child once she crosses 18 years

Post by kiran_tc » Tue Dec 23, 2025 1:48 am

Dear Sir/Madam,

If my spouse gets ILR and myself still not completed 5 years as dependant, what happens to a dependant daughter who completes 18 years of age and has completed 5 years as dependant. can she get ILR once my spouse gets it or my daughter need to wait until my ILR?

Requesting to respond on my query.

regards
Kiran

Assuming that the child was born abroad and is currently in the UK, they continue on the same pathway as the second/less-privileged parent and qualify for ILR with the second parent.

Being above the age of 18 does not make a difference to their immigration pathway, because they started under the age of 18 and are remaining on the same immigration pathway.

After acquiring ILR with the second parent, their dependent status ends and they will then need to meet all the same requirements as an adult for naturalisation (i.e. wait for one year after ILR, meet the English language requirements and LITUK tests, the absence and physical presence requirements, etc).
