10 year ILR

Post by Urwaha » Thu Dec 18, 2025 4:58 pm

I came on student visa in January 2017 and went back in October 2018. Student visa expired in October 2018.
I was diagnosed with tumor during that period and I went India and had surgery to remove tumor.
I then came back to UK in February 2020 on another student visa. Currently on parent visa until April 2028.
My question is will I be eligible for 10 year long residency ILR in January 2027?
I have all the medical reports and I can still get detailed reports.
Thanks

@zimba, I think the OP means to ask if they would benefit from the exception to continuous residence in Immigration Rule 3.4(c).
Appendix Continuous Residence: Absence from the UK wrote:CR 3.4. When calculating the period of absence in CR 3.1., CR 3.2. or CR 3.3., any period spent outside the UK will not count where the absence was for any of the following reasons:
...
(c) compelling and compassionate personal circumstances, such as the life-threatening illness of the applicant, or the life- threatening illness or death of a close family member; or
...
That is a point not covered in the link posted earlier. As you are more knowledgeable on this topic than me, I request you to respond more fully to this point.
