Hi Zimba, CR001

Thanks a lot for your help. I have submitted application yesterday and got ILR today :)

Can I apply ILR for Spouse (as super priority) now and once her decision is received, shall I apply to child as standard or child should be with spouse?

They are in UK since 07-July -2017 (for first 4.5 years on "PBS Dependent" while I was on ICT long term and then "Dependant Partner" while I was on Skilled worker and their current leave expires on expires on 25-Feb-2026).

Yes. One SET(O) application for your spouse and the child. They should apply as skilled worker dependant

Thanks Zimba. I'm applying for Spouse first and I will wait for Child application until decision is made for Spouse application.

While filling the form, there is a question "Enter their Home Office reference number:" - Is this settled person's ILR application Unique Reference number or Old Skilled worker Application Unique Reference Number ?

There is no reason to delay the child application. There is no need to enter a home office reference

Apologies for asking but for clarity to avoid mistakes -

Filling in SET(O) form for spouse, should I include Child in the same application by selecting "Dependent Child" in Add Applicant section ?

or

Two separate applications, with separate email registrations and then separate payments?

Hi Zimba
To avoid long wait, decided to purchase priority service at least for spouse and I have applied for spouse on Saturday and got successful decision yesterday (Sunday). Many thanks for all your inputs and they are invaluable.
Both parents are now having Settled Status.

Now submitting for child using SET(o), who should sign Part 1, 2 and 3 ?

Articles suggest that Part 1 by me as I’m submitting his application on behalf, Part 2 by both parents as using joint account utility bills and Part 3 by both parents as we are financially responsible for child.
Can you please help?

SET(O) is not a correct form for a child. SET(F) must be used for children when settling on their own!

But child is currently on my skilled worker dependent Visa. I recently got ILR using Set(LR) and my last work visa was Skilled worker at the time of settlement. Can’t I submit Set(O) as applying as child (dependent on work visa) ?

I submitted the form and paid the fee and booked for biometrics for tomorrow. Please help

SET(F) has always been the form to use for children under 18 to settle on their own. Their route to ILR is irrelevant.
SET(O) has always been used for adults. I checked and it seems the under 18 child dependants can apply on their own using form SET(O)
I guess if it is now possible for them to apply, then there is no issue to go ahead with this application at all

As appointment is booked for tomorrow morning 8AM, can you suggest the best approach please as the wrong form leads to refusal ?

As per https://www.gov.uk/indefinite-leave-to- ... -work-visa,
"If you live with 2 parents in the UK, both must be settled here, or currently applying for settlement." In this case both parent settled.

Using a wrong form does NOT lead to refusal. You will be asked to apply again and vary.
Again, it seems what you want to do is possible with SET(O). So for now, proceed as normal

I'm pleased to inform you that my child got ILR. This morning submitted Biometrics (Priority - £500) and evening got decision.

Now, we all three have ILR.
