how much time we can spend outside UK in five years

Post by ARPHsk » Sun Feb 15, 2009 11:44 am

how much time we can spend outside UK in five years for indefinite leave. I heard we can spend maximum 12 months outside UK in five years and 3 months maximum in last year? Is that right? Is there limit on particularly on last year?

You cannot spend more than 90 days out of the country in any one year of your time in the UK. If you do go over this then you MUST provide supporting evidence and explain why you did in your application.

If you went over by alot, then it is probably going to be bad news. :(

http://www.ukba.homeoffice.gov.uk/polic ... tionrules/

I think it's just borrowing a leaf from the US Green Card system that actually stipulates an amount of time you must spend in-country. But that's partly because the GC system exists so foreigners can pay taxes and support the aging population with Social Security taxes. If you are in your hometown abroad, obviously you can't pay taxes.

I haven't come across any documentation to that effect (that's not to say there isn't any, though). Spending 4 months at a time abroad is likely to raise issues with the EC officer who'll want ot know your source of income at that time etc. However, if you spend a 3 months here and a month abroad regularly, I think it would be ridiculous to hold you to account for that. I mean, some contractors are in their line of work just so they can take 4 months off every year.

But all this is just my opinion though. If there are rules (and we ever fnd them), then we should follow them.

Thats not true, that is 90 days in one go.
You can actually have more than 90 a year say 4 months alternating months would be ok, although frowned upon.

This is useful information but does anyone have something OFFICIAL from the HO website that clearly states the rules on overseas stays?
