If you are travelling in the company of, or to join, your EEA family member, then Directive 2004/38/EC says it's ok to carry your Stamp 4 EUFam Residence Card in lieu of a visa.

If you're travelling on your own, however, you will require a visa if you are a visa required national.

They are required to accept it, in accordance with EU regulations. However, this is only if you are travelling in the company of, or to join, your EEA family member.

In practice, you will not pass through border control in London anyway, since you will be arriving from ROI.

you have to get visa for UK, without wife they wouldn't accept your 4EUFAM.
one suggestion apply in british embassy dublin for a spouse entry clearence and you dont have to pay the fees which would be enitially for 6 months.

The solution in short: Book tickets through aerlingus.com (to London Gatwick for example) and check-in online within 30 hours and that's it. You don't normally need to show your passport in your trip to london (go straight to departure gaits in Dublin airport with your printed out boarding paper (your passport is in your pocket). You need to use your driving liscense for picture ID check at the gait just before boarding (to airlines people/security not immigration). When you arrive in UK, you will need to hand over the rest of the torn boarding paper at the gait and that's it. (no passports or stamps as it is a domestic flight). Only when you come back to Dublin, you will need to produce your passport and your irish stamp / green card (make sure you have an Irish multi or single entry visa). Have a sense of adventure and adrenaline but it is safe enough !! The only thing you can't do is to work in UK. In this case you need to apply for UK Family Permit (valid for 6 months) at UK embassy in Dublin, and when you move to the UK, you need to apply for UK Residence Card during the validity period of your Family Permit (EEA2 Form). The processing of RC in the UK is currently 8 months.

Best Regards

Does it true for Stanstard Airport as well ? Don't they have immigration control there ?

I strongly recommend that no one even attempts to enter the UK, nor any country, unless in possession of documents that legally entitle them to do so.

TRAVELLING TO UK WITH EUFAM 4 CARD

Post by El shaddai » Thu Mar 12, 2009 4:50 pm

thanks to everybody that contribute to my question,i am still not clear the question is has uk agreed with the Directive 2004/38/EC freedom of citizen and their families.bcos all the airlines are checking passports now at the airport before boarding pass and it s not possible any longer for non eu to check in online especially the ryanair. if i wanna apply for the visa at the uk embassy in dublin what are the requirements?and is it legal to go with my wife or at my own risk?bcos i dont want them to embarrass me and my wife at all.i will appreciate any vital and genuine suggestions.

El shaddai,

Are you travelling on your own, or in the company of / to join your wife?

  • If you travel together with your wife and yee have both your PP's and 4EUFam with you, you are >>legally entitled to enter the UK<<.
  • If you travel alone, you are not allowed to enter the UK.
  • As you can see from the link above, the UK home-office
    • refuses to interpret the following sentence as any normal person would
    • "Possession of the valid residence card, (...) issued by any Member State, exempts you from the visa obligation not only in the Member State which issued the residence card, but in all Member States."(>>this is quoted from the European Commission<< and does not refer to Schengen, but to all of the EU/EEA)
  • So they might de-facto (try to) deny you entry
  • Should this happen try to talk your way into the UK by bringing forward whatever you can learn in this forum.
  • As you are travelling from Ireland, you should in practice not encounter any problems...
  • ...read the >>practical guide on 2004/38/EC<<, travel to London and be happy.
  • Should you still get stuck, which is unlikely, contact a lawyer and sue the UK for compensation.
    • Yes, this would be lots of hassle
    • Yes, your holidays would be sort-of ruined
    • But - what alternatives do you have :?:
  • When I was still in the same situation I sucessfully entered and left the UK (Northern Ireland) three times together with my Lebanese wife. (Shopping in IKEA from Dublin, return journey 4 hours, applying for the Visa would have taken longer than that...) Luckily we were never checked, but a bunch of papers (as per the practical guide) were always with us, and I was more-less prepared to talk in a police-station for hours on end...
  • Edit: I found >>this additional information<< on the UK... I knew it had to be somewhere... Hope it helps...
ca.funke wrote:If you manage to get onto the plane to the UK, consider the following >>info<<, published by the homeoffice itself.
Before an Immigration Officer refuses admission to a non-EEA national under
Regulation 11(2) because s/he does not produce an EEA family permit, the IO must
give the non-EEA national reasonable opportunity to provide by other means proof
that he/she is a family member of an EEA national with a right to accompany that
national or join him/her in the UK.
