PSW rejected because of Maintenace!

My application was refused because of a lack of documentation to prove the funds.

Actually my account has always been over £800 but when I sent them with my application, I sent the latest statement which I had. I receive my statements quarterly and it covered 19th Sept to 19th Dec, while I applied on 26th Jan. Also I send them a stamped print-out showing the balance on 24th Jan.

However I've been given a notice to appeal by 31st March and have spoken to a solicitor. Do you think will I have any chance if I provide a statement covering the period from 24th Dec to 26th Jan satisfactorily? Can it make the appeal successful?

I did a mistake which was to apply very early while I had not received my statement. But they could have contacted me and asked for a clarification since the other criteria were met.

Sad to know. you must be joking- Ho will contact to clarify anything! they never do it.

You have made a very silly mistake. Now for that you have to pay solicitor. I don't understand why (clever) people in this forum don't take the criteria of maintenance fund seriously and try to meet the criteria. There are so many people in this forum think that Ho will give benefit of doubt. they never do that. They will try to see every possible reason to refuse your extension and let you go through the hassle of appeal. So that you learn a lesson and never do it again.

You must appeal and you will win.

I totally agree with RAJ, its the people who tries to be clever get caught. As long as you had £800 ALL THE TIME for the past 3 months IN THE SAME BANK ACCOUNT, then you will win the appeal. But appeal process is a bit long and you will have to be very calm and collective and please when sending AIT appeal form do not make any more mistakes or in other words try not to be too clever. I am sure you will win

Hello parham

I was refused on similar grounds and appealed and have just won.

I might be too late in helping you since your appeal deadline was 31st March but hope this helps.

You should have provided documents for the past three months immediately prior to the date of application i.e 25 Nov-25 Jan. No other dates matter. You should have used the quarterly statement to cover upto 19 Dec and then asked the bank to provide stamped statements/printouts of the rest as per the application form instructions.

All you need to establish before the judge is that you actually had £800 for every single day for the past three months, which you say you did. Your appeal should have stated that and explained how your quarterly statement was responsible for the 'lack of documentation'.

I would suggest on the date of the hearing take everything you sent home office (including 19sep-19dec statement, 24 Jan balance printout) along with statements till 25/26 Jan. You can then clearly explain what the problem was. I would also suggest if possible take the most recent transaction history to the hearing i.e if your hearing date is 20April, take statements from the bank showing your latest transactions and balance. Always helps.

The judge in my case was very thorough and wanted to know all the details. I even represented myself. So if you clearly explain what the problem was and establish you had 800 at all times, you should win. Good luck!
