Marriage - Immigration

Hi there

I was wondering if someone could give me a bit of advice.

I have a girlfriend from a European but non-eu country. I want her to come and live in the UK with me(UK national).

We are planning to get married for this to be a possibility, although we wouldn't get married yet if we didn't have to.

There are so many different visas out there that i'm a bit bewildered. Ideally I would like her to come and visit on a tourist visa first and see how she likes it here. My worry with that though is that, if it comes to us getting married they are going to ask about our relationship, and why she didn't mention she's in a relationship with me when applying for tourist visa.

ANother possibility I suppose is for here to come here on a tourist visa and us get married straight away.

Now she wants to study here too, so maybe she could get a study visa but that might be hard for her because she's not currently studying back in Serbia.

I would really like her to be able to work freely here and not have to wait for that right.

Also i'm wondering whether it may be better getting married in Serbia, maybe the process is easier.

Sorry this thread is confusing...but i'm confused, there are som many options going through my head, it's driving me mad!

Any advice greatly appreciated.

No that is not possible. That is, it is not possible for someone in the UK on a visitor visa to get married in the UK, unless they first obtain a CoA ... Certificate of Approval to Marry. But even if that was granted, then the two of you married in the UK, she would still need to go back to Serbia to apply for her spouse visa.

Based upon what you have posted, marriage really does seem the only way to resolve the problem. However I have to say that no one should ever get married just to ease a visa situation. The two of you should marry because you want to, and because you are ready to do so, and for no other reason.

If she marries you outside the UK, then she may apply for a spouse entry clearance.
Else, she may apply for a Fiancé(e) entry clearance and subsequently marry you in the UK.

Subject to Maintenance and accommodation.

Spouse entry clearance?, is that a visa that would allow her to come here and get married, is that different to a fiancee visa?
