Student Dependent To HSMP:Do I have to leave UK for FLR?

Hello all,

I am currently a student dependent visa holder and want to apply for HSMP. My question is, do I have to leave the country for FLR application if HSMP is successful? If yes, what is the maximum duration between the aprroval of HSMP and the application of FLR? The reason for asking is that I am now 4 months pregnant and don't want to travel out of the country for the next 6 months.

Yes
You need to apply for entry clearance in 3 months (as I recall!) after you get the approval.
Theoretically it takes 17 days to get the visa.

Nationals from non-EEA countries may apply to switch into the Highly Skilled Migrant category without leaving the UK provided they have existing leave as:

- Work permit holder; or
- Student who has successfully obtained a degree level qualification at a UK higher or further educational establishment; or
- Postgraduate doctor or a postgraduate dentist or trainee general practitioner; or
- Working holidaymaker; or
- Science and Engineering Graduate Scheme participant; or
- Innovator; or
- Applicant is undertaking the PLAB test, a clinical attachment or dental observer post, who holds a valid Home Office document confirming that he meets the criteria under the HSMP priority application process for general practitioners; or
- Fresh Talent: Working in Scotland scheme participant.

What if there are exceptional circumstances?
Switching from categories other than those stated in this leaflet will not be allowed except in exceptional circumstances. These circumstances will be assessed by caseworkers on a case by case basis. Circumstances relating to the job, employment and labour market will not be accepted as exceptional circumstances. Only circumstances relating to the individual which would make it unduly harsh for them to return to their country of residence may be considered as exceptional.

Thanks all for your reply. I was confused about EC and FLR earlier, and now I know I need to apply EC as I will apply out of the country. I just phoned Immigration and the lady suggested I might apply for urgent treatment. Or else I have to wait till next year.
