family/spouse visa

hi,
I am married to UK citizen woman more than 5 years & got 3 yrs doughtier (UK national) from her. I married her before she got UK passport/ILR. Now I would like to apply for UK ILR/Citizen, so my questions are:-
1) Can I apply for ILR straight or i need to get family/spouse visa first?
2) If i need to get family/spouse visa first, do I have to settle in UK immediately?
3) do I need to be in UK to apply or I can apply through Dubai UK embassy?
4) what is the requirements and documents needed to submit.
5) how long takes to get the visa/ILR

If you aren't currently living in the UK with your wife, you won't be applying for ILR. Where is your wife at present? If you have been married for more than 4 years and living together for the whole of that time outside of the UK then you could apply for Indefinate Leave to Enter in Dubai and then once you pass the Life in the UK test (KOL) after arriving in the UK you could then apply for ILR.
However, if your wife is currently living in the UK you will have to apply for a spouse settlement visa in Dubai, which if granted, under present regulations will give you a 2 year visa.
Citizenship will be some years away as the regulations are due to change which will extend the qualifying period considerably.
