ILR Absence on basis of HSMP JR new policy

ILR Absence on basis of HSMP JR new policy

Hi,
Congratulations to HSMP Forum and good luck to all who are going to benefit from this.

I am under the 1 yr(WP) + 1 yr (HSMP) + 4 yrs(Tier1 general) category. My four years completed on 17th Apr 2009 and was waiting for the new policy to be in place. Thank god, its all out now and I am likely to benefit from this.

My query is regarding my absences in UK. Total number of days absent = 245 days. None of the absences where over 90 days. However, I spent 60 days outside UK, whilst on maternity leave and another 40 days on compassionate leave. During these absences I was employed with the same employer and can produce evidences. Will this be discounted to bring down my absences to 140 days?

I have managed to get a PEO appointment scheduled for early July.

Kindly advice on my chances? Is it too risky to go in Person, as the allowed absences limit is only 180 days.

Would appreciate responses from members who have succeeded in a similar case.

Have you look at the above link for what you need to do.

There are guys who had 442 days absences got ILR based on employer letter. You are entitled 26 weeks of maternity leave with pay(Pay is based on how long you have worked for your employer) regardless how long you have worked for the employer and compassionate leave is given at employer discretion but usally work permit holders will be paid to keep them in status and continuity in employment.

Get a letter from employer you were employed and paid during your long abenese. Paid absenses are usally are exempted and won't be included while calculating total number.

I would suggest that you should hire a solicitor.It will save your time,money and you will not be hasseled.

Hi Tech
When you say guys with 442 days have had ILR, has this happened in recent times i.e this year. I have been away on maternity leave for 11 months (of which I worked from abroad for 5 months and was on statu maternity leave for 6 months) and have all my payslips. I am really worried if my case would succeed? I can get all the documentation from employer and doctor
