Student visa and child

Dear Moderators and members,

It is again regarding my uncle and his girl friend. My uncle is maried to an EEA national and is in middle of his divorce. He is applying his BC in December. He had a secret relationship with a girl who is on student visa and had a baby boy from her who is now two years and couple of months old. When my undle recieved his PR he applied for child's BC and was granted last month. Now problems are :

1) His divorce is not finished yet and his girl friend's visa is due to expire in December and she is going to apply for an extension as student as my uncle's divorce has not finalised yet and they can not marry.

2) In her previous extensions she did not mension that she has any dependants.

3) When the child was registered as british both natural parents passport's were sent together.

Now questions are :

1) When his girl friend applies for extension as student would there be any problem this time as she did not declare that she had any dependants and last application?

2) Does she have to declare even now that she has dependant?

3) Will HO findout from their data base that she has child and not been declared on this form?

4) Because her child is british what she should state on the form or in covering letter?

Failure to disclose any relevant information is a bad idea and could lead to refusal and other problems.

Then in principle no problem her applying for a new student visa, or rather a new Tier 4 visa.

Thanks John, What about declaring about her son on the form as dependant? Does she needs to do so as child hold British Passport?

Well I don't think so. Clearly as a British Citizen he does not need a visa to be in the UK.
