Hi all,

I was on IGS.

I applied TIER 1 GENERAL in Oct 2008 but got refused under paragraph 320 and home office accused me to have used deception and ban me from reapplying for 1 year.They thought that my papers are fake and they did not return my papers.

I got my employment papers again because I was a genuine employee and I sent those letters to home office and asked them to review their decision.But again they refused and told my there is no in country review.

I applied for PSW because my IGS was going to expire.But again they refuse my application saying that your application have been refused that your previous TIER 1 GENERAL application was refused due to deception.

This time they give the right of appeal and I went to AIT without any lawyer.And with the help of GOD I prove in court That I did not use deception in my TIER 1 GENERAL application and home office was wrong to refuse my application.
JUDGE allow my appeal and now I have got PSW stamped in my passport.

Now as I don,t have master degree I have wrote a letter to home office by a solicitor.We have asked them to change their previous(tier 1 general)decision as well because they were wrong to refuse my application.if they agree than ok other wise I planing to go for JUDICIAL REVIEW.

What you think guys where I am stand?How much chance I have got?

My lawyer is saying that we stand a very good chance,,,,,,

please share your ideas .....

A wrong decision should be overturned ... since you applied when masters degree was not a requirement and your application was refused becuase of lack of due diligence at UKBA's end (UKBA's fault) and an AIT judge has also determined so, I cannot see why UKBA should not change their decision regarding your Tier 1 (G) application.

It is a good thing that you're pursuing this through a lawyer / solicitor in a formal way, and not on your own.
