Married to British citizen but with EEA family permit in UK

Post by aminka2003 » Fri Jan 29, 2010 11:01 am

I am have been married to a British Passport holder for almost 4 years, however I am staying in the UK(London) on a EEA family member resident permit, as we have moved to the UK from Ireland.
I would like to know, firstly, whether I could change my immigration category to a
spouse of a UK natinal from inside of the UK or I have to travel back to Russia(Moscow) (
where I am originally from), will I be issued a definite leave to remain, or as I have
been told, an indefinite leave to remain. I have mentioned above, we have been married
for almost 4 yand first 3 years of our married life we spent in Ireland.
Also if i stay here on EEA family permit would i need to wait 5 years before i can apply for british cizien ship or i can apply in 3 years as wife of UK citizen.Hope you can help! Thank you

I don't think that you may switch to FLR(M) because you have no leave to remain (284(i)).

ILE endorsement normally requires KOL and 4 years marriage outside the UK (282(b)).

You cannot use both the EU route and the UK national route at the same time! It's one or the other.
