Post by merci » Wed Feb 10, 2010 12:51 pm

Hi
Our tier 1 Extension visa rejected on the ground of the weekly payment and monthly wage slip

We have been explanied in my cover letter that . But they seems did not take into account the explanations

No appeal right. What do you suggest to me.
Shall I go to solicitior or just do a fresh application

Regards

1. So u saying that u were paid weekly but wage slip was monthly.
2. So if you were paid weekly and wage slip was issued monthly then how come u employer worked out the tax and NI for weekly basis before u got u wages?
3. Does u total income in a month matches with u wage slip at the end of the mont or not and also the total of u weekly payments matches with u wage slip?
4. It seems like that there was discrepency between the wage slips and the actual money received which ended up in refusal.
5. Also were you getting paid cash (weekly as u said) and if yes did you deposit that money into your account?

Seems like the refusal is due to non-corroborating salary credits as shown in the bank statements (weekly credits) and payslips (monthly wages). So, IMHO, the caseworker is not at fault in refusing your application.

Since there is no right to appeal, all you can do is apply again. But in order for your application to be successful, you'll need to provide corroborating evidence(s) of previous earnings. IMHO, the only option for you is to ask your employer for a letter which clearly mentions weekly payouts of salary i.e.- gross pay, tax deductions, NI deduction, net pay ... for every week payments have been made in the 12 months you wish to claim points for. This way the caseworker will be able to see exactly how much money you have earned - based on two corroborating independent evidences (letter and stataments).

Exactly the reason is not coroaborating payment and wage slips

Actually I did explained that in my cover letter and
the complication is because of payments are weekly and the salary slip monthly the payment
which means while the salary slip issued for 30 days
the calculations of the weekly payments can not be match due to
4 weeks payments is ok but the 5th week's payment has to be divided
which a part of it belong to this week and the remain one is belong to
the other month.

Eventhough there is enough explanation about that in my cover letter they still refused it . Is there no other way than a fresh application , do you think?

IMHO, explanation is of no value here as the evidence(s) presented are not in line with the requirements!
Monthly payments -> monthly bank credits -> monthly payslips
Weekly payments -> weekly bank credits -> weekly payslips

@ash786
1.ok
2.calculations at the end of each month for tax issues
3. of course matching, just need to pay more attention than other cases
4.there were no discrepancy, just a little complicated.
5.the payments were bank payment

@sushdmehta

Do you mean that
weekly payment > P60 is a better option than monthly issued salary slips as evidence

P60 works as evidence only if you are claiming earnings points for the 12 months between Apr-Mar (UK tax year).

If using Apr-Mar period to claim points for earnings, then yes, you can use P60 with either bank statements or payslips (preferable).

Many Thanks for the answers, I think waiting for April and doing a fresh application is a better option.

just to be on safe side I want to check again

Eventhough they are paying me weekly and issuing the salary slip monthly,

Will I be good
If I presented my P60 for the period of April and March alongside of
the bank statements for the previous earnings.
