Yes you can from within UK, if your current visa is still valid.. if not valid.. apply from your country of residence

Do you meet the requirements based on your current earnings? What is your current status and why was Tier-1 declined first time around?

Hey debos,

sorry to hear that u cud not get through your tier1.
Like to add up a point here, when asking queries on any forums you need to be case specific and give a bit of details in your post so that senior members and mods can try to anlyse your situation and provide you with a suitable solution.

If your current visa is still valid.. you can apply from UK itself if not apply from country of residence.

you don't need to wait for 1yr if u qualify now..

Hi Push,

Thank you all for answering my query. My tier 1 was declined because i was unable to qualify with my salary. I know i was not able to make the required 75 points, but the solicitor told me i can still apply.

Is there anything more to be said? :o

You may make a fresh application as and when you qualify. Whether you can do it from within UK depends on whether you have valid leave to remain at the time of application. If not, you can only apply from home country / country of legal residence.

regards

dabos wrote:I came to the UK on the HSMP with expiry date September 2009. To extend my visa, I could not qualify as my earnings were not enough. I contacted a Solicitor in March 2009 who told me to start a company and claim that additional earnings. I was still not able to qualify as the earnings were still not enough. The solicitor advised me to still apply under the HSMP programme although I did meet the 75 points requirement.

My visa was refused in October 2009, the solicitor advised me to appeal the decision based on the economic conditions, which i did. I went to the appeal in December 2009 and lost. I contacted another solicitor who told me my other option was Tier 2, that I should ask my employer to give me a Certificate of Sponsorship.

My employer decided to advertise the position again, with the hope that if I reapply I will be selected and pass the Labour Market Test. The interview is sometimes next week, I am not sure if they will still refuse my visa.

Has anyone has this experience? Please let me know.
I got that post of yours from another topic!

Its unfortunate that you got a rejection after your appeal. If you are still in the Uk after you lost appeal in dec 2009. You could be overstaying!!!

The solicitor is misinforming you. You cannot switch your visa category in-country except you return to your country home.
