Can someone please provide me with the best options for my wife’s visa:
My wife's application for Tier 2 visa (General) sponsored by the Coventry University has been refused on the basis of lack of evidence for English language, qualifications and funds. She came to UK in September 2006 for pursuing PhD and at that time University did not require her to pass an IELTS/ any other English language test, so for this category we produced a letter from PhD supervisor stating that she did not encountered any difficulties with English language during the course of study.
My wife has completed her PhD but have been advised some revisions after viva, which the PhD supervisor declared can be pursued on part time basis while in a full time job. We claimed points for Masters, but UK Home Agency did not consider original academic transcript and membership letter from British Psychological Society as enough proof of qualifications.
For funds, the opening and closing balance was always higher than £800 in last three months' bank statements but funds were sometimes lower during the month.
My wife has also had her Biometric appointment on 17th March and the refusal letter came on last saturday. Letter states that we don't have a right to appeal as visa leave has expired and she should return to India asap.
The next option in our knowledge is dependant visa, as I am on work permit since feb-07which will expire on Feb-12, for which we understand we need to go back to Delhi? Do you have any other advice, what do you think is the best option for us? My wife is in the middle of making her PhD revisions and will ofcourse want to continue her job too (which we doubt she can?), do you think because of this refusal, processing time for a dependant visa might be longer in India? Also, my wife has had amount of £533 consistently in her bank account at all times for last three months but I didn't have £800 in my UK bank account. Can we show funds in an Indian bank (in my name) as proof of available funds for dependant visa to stay in UK?
