2nd application while waiting appeal?

Hello, if I'm refused Tier 1 and decide to appeal, can I change my mind and send Tier 2 instead while appeal pending? Many thanks

IF 28 DAYS r not expired from yr visa last date than u can ,

all cases u can but HO will sit on it
