British Citizenship/passport For Uk Newborn Baby?

Post by Andrew2412 » Sat May 15, 2010 6:46 pm

Good afternoon everyone!
Could you please help if you can with the dilemma we have.
My wife and i are both EU citizens who lived in the UK since 2002 and 2004.
We would like to apply for british citizenship/passport for our baby daughter who is just 4 weeks old and were born in the UK.
What exact steps should we take in order to start the procedures in application.we have baby`s birth certificate in place and as we both eu citezens and lived/settled in the uk for more than 5 years.
I have read all the available info on UK boarder agency website and it looks straight forward but then i were getting passport application form from post office, lady behind the counter have confused me and herself as she was not sure what to do and how to check the procedure.
If anyone can give us an advise on what to do and how to do it we would much appreciate that.
Many thanks in advance!!!

May be better to get Confirmation of British nationality status first for the child.

I am not at all surprised that the lady at the Post Office does not understand the "small print" in the EU Directive.

Have either you or your spouse ever applied on form EEA3 for confirmation of PR status? If yes, and that PR status has been confirmed, clearly there is no problem here.

But if no such applications have been made ..... and there is no compulsion for the applications to be made .... PR status happens automatically after 5 years of exercising EU Treaty Rights in the UK .... under the terms of the EU Directive .... just supply proof of exercise of those Treaty Rights, such as 5 or more P60s ..... and your child should be issued with a British passport.

But don't necessarily expect someone at a Post Office to understand all this "small print".

I would say this is essential for any child born in the UK with non-British parents, as otherwise there may be problems renewing passport later on if parent's status cannot be proved.
