Married Zimbabwean Overstayer question

Post by zizzle » Tue May 25, 2010 2:57 pm

I am a Zimbabwean overstayer ,and i have been in the UK since 1999 ,i went to college for 2 to 3 years before my finances dried up and so i just started working to support myself .I didn't apply to extended my visa because i could not afford it and so the home office haven't asked me to leave or anything like that.

I got married legally in 2005,My wife now has been granted her Indefinite Leave to Remain under the 10 year long stay.Having been to see many lawyers who advised us that it will be better if we went to sort this out in Zimbabwe we are planning to go asap to sort this stuff out .We have collected the information on the below link

http://www.immigrationboards.com/viewto ... ht=#242311

except for one or two things like - Immigration Advisory Service Statement (To explain reasons for my overstaying)
which i am working on getting ,or if anyone can help with the details which one of these documents would usually have on them, as i understand i can do it my self due to the fact that i need to leave for Zimbabwe asap and i dont have the time to see the Immigration Advisory Service

My main questions are

1) Before i leave do i let the Home office know i am leaving (even though they haven't asked me leave before )

2) Will i get problems at the Airport as i will be leaving using a ETD and i am an overstayer

3) When i get to Zimbabwe should i let the case worker know i was working and show them my CV and work Payslips to show them that i am able to support myself with taking public funds

IF ANYONE HAS ANY RELEVANT INFORMATION I WILL BE VERY GRATEFUL TO RECEIVE IT

1) no
2) You may get stopped and it may get noted down that you're an over stayer. However, this won't count against you in your situation unless you used some kind of deception in the past.
3) Yes (I think you mean without using public funds).
I tell it like it is.

Remember in Zimbabwe you will not be seeing the caseworker face to face like other countries. They are based in SA.You will be sending your application via an agency based in Zim. So ensure you have all the information required in a folder which will then get sent to SA for consideration.

This link will give you the details for when you are ready to make the application e.g where you pay your application fee and contact numbers: http: //www.vfs-uk-za.com/Zimbabwe/index.aspx

Apologies if you already have this information. Just thought I should mention it.

Alternatively, just apply directly in SA. My cousin flew to SA from Zim on Monday, applied online same day, had biometrics on Tuesday (strange as I thought it was a holiday), visa granted by this morn. Flying out tonight, will be arriving tomorrow morn. Pretty efficient even if I do say so myself. Thank God for the internet. Makes everything so streamlined.

PS. Thats assuming you have plenty of family in SA to stay with! No need to spend money on accommodation. :)

Agree with Thandia, applying in SA in person is quicker than from Zim.

I was also advised i could i write myself if i fail to see the Immigration Advisory Service if anyone knows anything about this document and you have an example or an idea what i need to put on i would be very grateful if you can help me if you have a copy you can email it to johacullen@gmail.com

The only people who would know of this document are people who have been represented by the Immigration advisory service.I think you misunderstood me. Going to see the IAS was not just to get a statement from them. It was advise for you to go and see them and present your case then they can help you like you would get help when you go to see a lawyer. The statement (covering letter)I got was because I was a client. We had gone through my situation and they had recommended what I need to do/get for my application. The statement they gave me was in support of my application to say that I had met the immigration rules requirements based on all the evidences I provided for the application.

Most people (like yourself) do not seek legal representation when making a spouse visa application and therefore this statement will not apply to you.

The information I said you could write for yourself is for Section 9 (additional information) of the vaf4 application form for any other information you wish to be considered in support of your application.

Maybe you could get ideas from this forum as to what you need to say in this section. You may not need to add more information in this section at all… in which case you can leave it blank! This is my opinion. Anyone to help Zizzle on this?
