Admin Review or Appeal? PSW Dependent Application

Hi All

I have PSW visa, I applied for my wife's visa as dependent on March 24 2010, which was refused due to insufficient funds. My agent in Mirpur made an appeal against that sending the papers by fax to First-Tier Tribunal Loughborough.


On the appeal form (IAFT-2) it is written to return the papers to:

1. A UK number OR

2. First-Tier Tribunal Loughborough OR

3.British Embassy, Visa Section Abu Dhabi


I have read on UKBA website that for outside UK applications, only admin review is performed (is that correct?)

My other question is where the Admin review will be performed as the papers are sent to First Tier Tribunal which sound more like a court (does not sound like admin review will be done).

Finally I want to know how long it normally takes

Any help will be highly appreciated.

Out of country applications are subject to admin reviews. The next option available to you would be mentioned on the refusal letter received. However, do you think that the maintenance funds are ok and it was genuinely a mistake by the EC officer?

Thankyou for your response, Its a mistake because my bank statment attached is from december to march 2nd and balance is £2195 through out. my other bank statment is from November to January and shows daily transactions and wages. their requirement is to show £533 for three months and statement not be more than 30 days old. which is clearly satified by one of my bank statments.


we have made an appeal but there is no mention of admin review, or anything like that on the refusal letter. I want to know how long it normally takes to do the admin review/appeal.

That depends.. the usual date for an admin review/ appeal decision is 28 days but it has been known to go upto more than 2 months from a personal experience of mine..

Hi, mine is a similar case. My visa was refused on the grounds that i have not submitted 3 mths bank statement which i did.

From the advice that i got from various people, you can file for appeal or admin review. But i have been adviced that appeal is better than admin review because a judge is involved. U can wait - i have been told that the decision is overturned by the ECM usually and it doesnt go to court for hearing. Also, you can always file for a fresh application at the same time while still in appeal

Getting an option to appeal or go for an admin review is not something that you can opt. If it is an out of country application which is rejected, you get an option to go for an admin review. An appeal can be opted for if the application rejected is an in country application. PERIOD!!
