Applying for tier 1 if spouse is applying for student visa?

Applying for tier 1 if spouse is applying for student visa?

Hi,

I am applying for student VISA however want to check if it is acceptable/recommended for my wife to apply for Tier 1 (assuming she is eligible).

Also assuming that it is ok for her to apply for tier 1, should I mention on my form that she will accompany me? In case I write that she will accompany me, would it be implied that she will join me on student dependent or would she have freedom to choose VISA category (Student Dependent or Tier 1)?

Request inputs as soon as possible. Thanks

If your wife is eligible to apply for Tier 1, then you should consider applying as her dependant.

Thanks Vinny, I am also eligible for applying for Tier 1 however my intention is to study in UK. Considering my purpose and the fact that my course is likely to start soon, I am applying for student VISA. However need guidance about VISA category for my wife. I assume Tier 1 will give her flexibility however I am not sure if VISA office considers it appropriate for student partner to apply for Tier 1.

If she is eligible, then why not apply? I believe that Tier 1's dependants may also study.

Ok, Great! So you see no issue in my saying in my student visa application that she will join me later and then we can file her Tier 1. Please let me know if you recommend not mentioning that she will join me later as she will be applying in independent visa category.

Actually based on my earlier search, I understood that if I intend to study in UK it's better to apply for student visa and not tier 1. Also for tier 1 dependant, I intend to go to UK few months before my wife hence dependant category for me is not likely to work for me. In addition, now I have prepared my student visa application and have an appointment on Monday.

Dependent VISA - Child

Hi,

I have got my student VISA (tier 4) and hope to apply tier 1 for my wife in next few days. Considering lower cost of tier 4, can I apply for tier 4 dependent for my baby? or since baby will be travelling with my wife at later date, would it be better to apply for tier 1 dependent (despite higher cost). Request your inputs. Thanks

- I am having tier 4 VISA
- We are applying for my wife's Tier 1
- My daughter is planned to travel with my wife later (after my travel)

Would it be okay to apply for my daughter's Tier 4 dependent to save VISA processing cost even if she is likely to travel with my wife (having tier 1)?

Why so complicated?.. If your wife could apply for Tier 1 General, than you and your daughters could also apply for Tier 1 dependent (and you can study as a Tier 1 dependent).

The only reason to get Tier 4 is to save on costs now. But if you want to switch to Tier 1 dependent next year, you'll have to pay this anyway.

Thanks for your reply! Since I already have tier 4 visa (based on whatever inputs/advice I had at the time of my application) and we have determined that tier 1 will be best for my wife, I want to determine VISA category for my daughter. Although I realize that I might need to apply for tier 1 dependant next year however am okay with it and would like to save some cost this year.

Would it have any -ve effect on my daughter's tier 4 dependant VISA application, if my daughter is likely to travel with my wife (having tier 1)?

Will appreciate responses!

If your family wishes to eventually settle together in the UK, then it may make more sense (as hinted before) for your wife to be under Tier 1 and everyone else to be her Tier 1 dependants.
