FLR(M)

Post by nishsil » Fri Aug 06, 2010 6:33 am

Hi all,

I need to clarify some thing please.

I got my ILR under 10 year long residency category last month. My wife came to UK as my Tier 1 PSW dependant in last January. Now I need to apply to change my wife's visa to ILR dependant on FLR(M). Earliest appointment we can get is 4th September in Liverpool for the same day premium service. Will there be a problem when we attend the interview since there is a gap between middle of July to beginning of September where my status was ILR but my wife's visa status was Tier 1 PSW dependant? (Will they say she has been on the wrong visa for 1.5 months?)

Please advise me...

Thanking you all......

Shouldn't be a problem if her leave hasn't expired.

Hi Vinny,

Thank you for your answer. Her current dependant visa expires in march 2011... should be ok right?

Should be okay. However, don't travel out of the UK before she's granted FLR(M).

No we don't plan to travel befor FLR(M) is granted. Is there any purticular immigration provisions or rules that you can point me to so I can keep it with me ready to show them in any case if they start giving problems vinny?

Thanks alot for your help...

I believe that her leave is still valid because it hasn't been cancelled at port under 321A (that's why she shouldn't travel) nor curtailed under 322.

The flr(m) clearly states what documents you need on the form. Have a read please.
I tell it like it is.
