Dependants applications

Post by student11 » Thu Sep 09, 2010 4:08 am

Hi

I am going to apply for my post-study permit soon. I have recently got married here in teh philippines to my same-sex partner (woman). I would like to call her to the UK. HOwever, our marriage is not legal it was just a holy union meaning no laws involved. How can I call my partner to the UK? Please guide me on what evidences can I provide? Also, I do not have a job at the moment. does it matter? or you just need the maintenance funds?

thanks

I think you should first proceed to apply for your Tier 1 (PSW) visa, and then get a job, because without that visa and a job, there is no way to get your partner here.

The next problem to mention is that the UK will not currently recognise you as being in a Civil Partnership, or the foreign equivalent thereof. And until she is so recognised as your Civil Partner there is no possibility of her getting a visa as your dependant.

So somewhere in the world, possibly in the UK, the two of you need to register a Civil Partnership, or a foreign equivalent recognised as a Civil Partnership by the UKBA. Download this UKBA document and read 4 in particular, which gives details of the accepted foreign equivalents of a UK Civil Partnership. Any of those seem possible?

Or are we looking at registering a Civil Partnership in the UK? If so she will need to come in as a visitor, and until CoAs are abolished at the end of 2010 or early in 2011, that would need to be the special type of visitor visa permitting the registration of a Civil Partnership. After the Civil Partnership is duly registered she would need to return to her country, and then make an application to be treated as your dependant, on your Tier 1 (PSW).
