Help me please not sure when to apply for ILR???

Hi All,

My husband came to the UK on a spousa visa on the 7th Dec 2008 his visa expires Feb 2011 please could someone tell me when we can apply for ILR as I am very confused with the dates etc thanks

He may apply for ILR between Tuesday, 9 November 2010 and before his visa expires. KOL required.

Hi Vinny thanks alot this is all so confusing!! he has passed his Life in the UK test thankgod could I ask what do they mean 6 documents from 2 different soucres?? I dont have six letters in Joint names most are in singel names really your advice would help me thanks

Individual names are fine, as long as all the bills have the same address on them, to show that you are living at the same address.

A joint mortgage statement, or tenancy agreement would help though if you have one.

A minimum of 6 proofs of joint address from 3 different categories would be for example:
2 Utility Bills
2 Council Tax bills/statements
2 Telephone bills
This would be 3 different categories.
You can also include medical letters, TV licence etc. You may have more correspondence during the last 2 years than you think you have.
If you don't have proof of address in joint names, include more than the 6 requested in single names.
They should be spread as evenly as possible throughout the 2 years.

Do read form SET(M) > SECTION 12 - DOCUMENTS Note 8 carefully.

If you do not have enough items in your joint names, you may also provide items addressed to each of you individually if they show the same address for both of you. Examples of acceptable letters and documents are listed below. They must be originals.

Examples of different sources are included, e.g. Gas bill, electricity bill, GP letters, bank statements, etc.,

Arrh many thanks to you all this is such a scary time I had a hard time getting hubby here would hate to think of the worse and what would happen.

Thankyou so far we have in Joint names

Gas
Water
Council Tax
Child Tax Crd Form
Bankstatements
Savings account

The rest are in Single names for exmaple, Dsa documents, Dentist, Sky Phone bills (mobiles) Hosptial letters husbands paysilps, Tv Lincence etc etc

I am hoping this will be enough

one last question when you say as evenly as possibale should I do it like a bill every 3- 4 months covering the two years?? would that be ok thanks again

Sally, all looks fine. Just spread as you suggest, with no really BIG gaps.
Some people only have junk mail.

It's not how much money you have in the bank. It's about showing that you are able to support yourselves financially.

i think you need to show as a couple you need to have Â£90 pounds of income per week which = enough money to support yourselfs.

It's not Â£90 per week. The calculation based on current level of income support is Â£102.95 remaining weekly for you both after rent or mortgage, council tax and any loan repayments have been made. Additional amount of Â£60 approx weekly for each child.
With spouse ILR applications more focus is placed on the fact that the relationship is continuing and proof of joint address than finance.

I was told the same thing the the caseworker wants to ideally see that the marriage is real etc rather than finance, so i'm told...

my only worry was that i'm not working and was conviced we could get refused on this however we do have savings if need be to support oursleves. Do you think its wise to write a support letter explaing why i dont work

Sally you don't need to be employed. As long as you're supporting yourselves financially it doesn't matter whether you work or not.

1. I got my HSMP is Feb'06 but got a job in Oct'06, is that going to be a problem and do I need to do anything about it?

2. I understand the fee for ILR will go up to Â£1295, is that correct?
