Tier 4 to Tier 1 / Tier 1 dependant

Hi,

I am studing on Tier 4 visa and my spouse holds a tier 1 visa. From point based system perspetive, I am currently eligible to apply for tier 1 or tier 1 dependant. I still have around 10 months of course left. I need help with following queries
1) Which of the above category is better? As I understand the primary purpose of tier 1 is to work and hence want to make sure if tier 1 dependant will be more appropriate (as then I am not obliged to work)
2) Can I switch into above categories while remaining in UK? If not, then do I need to necessarily go to my home country or Can I get it switched by applying in any other country?

Yes, you may switch from Tier 4 to Tier 1 (General) .... if you qualify for Tier 1 (General) without claiming points for earnings. So, the question is - do you qualify?

But you cannot switch from Tier 4 to Tier 1 (General) dependent. You'll need to apply for EC from home country or any other country where you may hold legal resident status (excluding UK).
