am i exempt from market labor test?

Post by raoul1987 » Sun Nov 28, 2010 11:28 am

hello guys
i am wondering if i am exempt from the market labor test?

details: i have been with the same company for more than a year now, on a Post study work visa, and trying to switch to tier 2 ( it is considered switching and now a new initial application isnt it?). my role now is different to the one i initially started i.e trainee pharmacist for the last year and now i am a qualified pharmacist.
do i need to be doing the SAME JOB in the last 6 months to be exempt, so as long as you work for the same company for the last 6 months you will be exempt from the market labor test?

Regards

a simple visit to ukba website would have answered your query and saved your time....

Code: Select all

http://www.ukba.homeoffice.gov.uk/workingintheuk/tier2/general/eligibility/switching/

Code: Select all

You must have worked for your current sponsor for at least six months immediately before the date of your application. You must be applying to continue to work for your sponsor in the same job you are doing on the date of your application
looks like you will be ok as you dont need to be doing the same job when you were hiredl only make sure u r doing the same job at th time of app as mentioned above.

Hi Arsenal49,

Yes, we do lot of search for our queries, thats why we have reached this forum,

My understanding of Forums and discussion boards is like discuss or ask personal experiences or expertise.

Its like talking to friends and their experience of same situation if they have one.

Put yourself in our situation, would you expect a link to UKBA (Which provides very broad and generic information not specific) website when you asked for specific situation or problem.

I have seen many posts of members which quite rude.

I think this forum should have more friendly replies.

Thanks

Hi Arsenal49,

i love your use of the royal "we"!

when it is the matter of the law, its no use if your friend A say what you want to hear or friend B say what you were always afraid of. I didn't know the reply to OP's questoin so i opened the website and VIOLA it was right there infront of me on the first page. The OP waited and probably wasted couple of days over the simple query when it could have been answered by visting the website.

was it helpful or not, in this case, and if you say it wasn't than i would beg to disagree with you!

I have seen many posts of members which quite rude.

Someone needs to stand up and call spade a spade. Its only in the interest of the OP, in long term. Atleast you will be getting an honest reply and not what you want to hear but secretly kows its not the right answer!

Thanks

my employer just issued me cos and emailed me the number. however i dont fully understand what else information shall i ask for? like i got the CoS number but do i need to ask them for any more details i.e job codes/job title or what they actually put to get the CoS.
i am looking at an application form now and it seems a bit complicated for me to digest everything

COS is just a certificate number and technically all you need,

however you should request the print out of the whole page on the application management system and make sure your job title, description, salary etc. conforms to code of practice, i.e pays right salary etc etc.

its up to you to point any descrepancy in the COS details, as recorded by employer. otherwise, there is a possibiity to get rejection if your employer has made a mistake... hope you see my point

im sorry i can't give you a source of my reply, but i read somewhere on ukba website, that you RLMT is the requirement for ALL out-of-country applications. however, i stress, im not 100% on it so, please , do your research to get the definitive answer
