Marriage at 19 and visa change

Hi everyone,

I am aged 19 and a half and I am a British Citizen. My boyfriend is a Pakistani National and is here on a student visa valid until August 2011. We are planning to get married but I was wondering if he can change his visa to a spousal visa, or do I have to turn 21 for him to be able to do so.

Secondly, if he is able to apply for a spouse visa will that be possible whilst residing here or will he have to return to Pakistan and apply from there.

Unfortunately you won't be able to apply for a spouse visa until you reach the age of 21. If he still has a valid student visa (and his studies are continuing) when you are 21 he would be able to switch to a spouse visa from with the UK by applying for FLR(M) (Further Leave to Remain).

you and your husband, wife or civil partner will both be at least 21 years old (or 18 years old if either of you is a serving member of HM Forces) on the date when we would give you permission to remain;
