Ancestry visa extension when the 5 years is up

My partner (Australian) & I have stayed in UK for 5 years but he isn't eligible for ILR due to extensive time out from the UK. Whilst I'm eligible for ILR, however due to my partner isn't, and he's not a UK national I believe that I won't be allowed to apply for ILR either.

So my question is, to continue living in the UK (we have a small international property business we run together) and since our 5 years visa is up in a month's time, do we have to just extend it another year? Thank you.
