My mother is in UK on ancestry visa. My father and I are here as dependants and were living in Birmingham.

I am 22 and having finished university am no longer living with parents as working in London supporting myself -I pay my own rent and share a flat with friends.

What is my status - my dependency visa last for another 3 years. Can i stay until that expires - even though technically no longer dependant? Or am i now technically illegal? Parents are about to apply for ILR

Although you may remain in the UK on your dependant leave until it expires or it's curtailed, if you lead an independent life, then you cannot be included with your mother's ILR application. Moreover, you cannot travel and return to the UK on this status.

If you want to be eligible for ILR with your mother, then you should still be dependent on her and not lead an independent life.

Thanks for response - appreciated.

Regarding travelling - I have been travelling on this passport in Europe with no apparant probelms. Presume this will continue - unless I am "flagged"

My concern is that if my mother applies for ILR does that affect my status - will i suddenly find that my "dependancy" is questioned and my visa curtailled or am i OK until it expires. I appreciate that I would have to apply in my own name at that time it expires if I wish to remain.

Any assitiance appreciated

If she is shortly applying for ILR, why don't you remain dependent on her so that you may apply for ILR at the same time as her?
